Arrested for DWI?

North Carolina’s Safe Roads Act states that you will be considered to be driving while impaired if you have the following blood alcohol concentration levels of or higher while operating the vehicle:

  • 0.04% for individuals who have received prior DWIs
  • Anything above 0% for individuals under the age of 21

Even if a driver has a blood alcohol concentration that is below the legal limit, that person can still be convicted of DWI if it can be shown that his or her driving abilities were appreciably impaired due and/or alcohol or drugs.

Additionally, the state’s DWI laws prohibit the following:

  • Having an open alcoholic beverage in the vehicle if the driver is or has been consuming it
  • Having a closed or open alcoholic beverage in the passenger area of a commercial vehicle
  • Helping an individual who is under the age of 21 obtain an alcoholic beverage in any capacity
